Tree Service Sued After Illinois Wood Chipper Accident

The Madison-St. Clair record reports that the wife of a deceased man filed a wrongful death lawsuit against the tree services where he was employed. The accident occurred on November 18, 2011 when the victim was working for the tree service feeding tree limbs into the wood chipper. His jacket became caught in the wood chipper while he was loading the trees and was sucked in and killed. The victim’s wife is now seeking justice for her husband’s wrongful death. Her lawsuit claims that the defendant tree service negligently failed to provide adequate training to her husband, failed to warn its employees of the dangers of improperly loading branches into the wood chipper, and demonstrated the improper way to load the branches. She is seeking a judgment of over $300,000 plus costs.

Since 1992, our team of 16 attorneys has recovered millions in wrongful death verdicts and settlements for families. Our outstanding results have earned us the reputation as one of the leading wrongful death firms in Illinois.

In fact, one of our most notable settlements for a wrongful death case involved a $6.5 million dollar settlement for the family of a woman who was killed when their pick-up truck was rear-ended by a semi-truck in Kane County. Our client and his son also suffered significant personal injuries in the collision. The defendant truck driver was found to be under the influence of marijuana and operating an over-loaded, unsafe truck. Additionally, the defendant truck owners failed to drug screen or perform background checks on their drivers, in violation of federal regulations. This settlement was named as the largest settlement in Illinois outside of Cook County by the 2011 Chicago Lawyer Settlement Survey. The wrongful death portion of the suit, $4.7 million, was the highest wrongful death settlement recorded in Kane County.
