The Daily Herald reports that the family of an Aurora man who was killed in a car crash near Oak Brook, Illinois has filed a car accident lawsuit against the driver of the car. The victim died on November 13after being thrown from the passenger seat of a Ford Mustang that veered off of westbound I-88, slammed into a guardrail, and rolled over. The family is now suing the driver of that vehicle, accusing him of speeding, failing to pay attention, failing to keep his car in “proper mechanical and working condition” and being otherwise negligent. The family is also awaiting the results of the Illinois State Police investigation and accident reconstruction unit’s reports about the accident. That will likely include any alcohol results and will aid in better understanding the accident. When the crash happened, both men were taken to Advocate Good Samaritan Hospital in Downers Grove, where the victim was pronounced dead but the driver only sustained non-life threatening injuries. This accident occurred at an especially devastating time, as the victim’s family had to bury him on what would have been his 30th birthday.
Each day, millions of people throughout Illinois use cars for transportation. Every time a driver gets behind the wheel of a car, he or she is accepting responsibility for the safety of everyone else on the road, including his or her passengers. In 2012 alone, there were 946 roadway fatalities, according to the running total kept by the Illinois Department of Transportation. When a driver’s negligent behaviors or careless actions lead to the injury or death of another person, the negligent driver must be held accountable. Our team has helped victims and their families seek justice and the compensation they deserve for over twenty years. Wrongful death lawsuits compensate families for harms caused such as medical bills, pain and suffering, expenses associated with death, and the earnings the deceased person would have provided.
