As our readers are aware, winter weather can pose a lot of hazards and increase the likelihood of accidents when people are not cautious or when proper safeguards are not in place. Most of the time, when we think of winter weather accidents, we tend to think of motor vehicle accidents. However, these accidents can occur with other types of vehicles as well, and not just on main roads.
One Illinois man was killed this week when his snowmobile hit a “fixed object” on Rockdale trail, reports the Joliet Patch. The autopsy showed that the victim died of multiple injuries that were the result of the snowmobile accident. It is currently unknown as to what the object was, and the Illinois Department of Natural Resources Conservation Police is investigating the accident and trail. Further investigations may reveal whether the trail was in a safe or dangerous condition and why the object that caused the accident was in the path of the driver.
While it is unclear in this case whether the death of the victim was the fault of another, the victim’s family, like others who have experienced the loss of a loved one, are understandably grieving this unexpected loss and are presumably looking for answers. When someone dies as a result of another person’s negligence, their surviving family members may be able to take legal action to hold any and all wrongdoers accountable through wrongful death actions. In wrongful death lawsuits, the court determines that but for the accused party’s actions or inactions, a death would not have occurred. It is this negligence or harmful action that is determined to be the cause of the victim’s death. In this case, the family could seek compensation if an investigation revealed that the accident was caused by unsafe conditions or another rider’s negligence.
