Elderly Pedestrian in Critical Condition After Accident Caused by Drunk Driver

The Chicago Tribune reports that an 87-year-old pedestrian remains in critical condition after being struck by a drunk driver in Chicago’s Uptown neighborhood last Friday, November 9th. The victim was struck while trying to cross the street in the 4700 block of North Broadway around 7:05 a.m. The driver, a 26 year old resident of West Rogers Park has been charged with felony DUI resulting in serious injury and was also cited for striking a pedestrian, running a red light, and driving without insurance or a driver’s license.

Senseless injuries like this one serve as a constant reminder for pedestrians to remain vigilant while on the streets of Chicago. This victim was minding his own business and crossing within a crosswalk when a drunk driver who was not paying attention hit him out of the blue. These types of accidents are entirely preventable by these negligent drivers. However, they have unfortunately become an all too common occurrence in Chicago. No matter what time of day, pedestrians must be aware of their surroundings and of others because too often Chicagoans hear these sad and avoidable tragedies.

Chicago municipal code outlines pedestrian rights. For instance, pedestrians have the right of way when in outlined crosswalks, when on sidewalks that intersect with alleyways, and when the pedestrian is blind. If there is no sidewalk, pedestrians may walk along the roadway but they must walk on the left side of the road or the shoulder facing traffic approaching in the opposite direction. Of course, pedestrians must follow all posted traffic signals and must exercise due care. Further, pedestrians must be aware that they must yield to all vehicles unless they are in a marked crosswalk and may not cross a roadway in a diagonal manner, but only at right angles. Finally, pedestrians may not enter into a railroad grade crossing or upon any bridge while such gate or barrier is opening or closing. Keep these laws in mind while walking around and always remain vigilant.
